Diagnostic center(s)

The term "Diagnostic center" refers to the facilities listed on the Mytesto.in Platform, which includes Diagnostic centers, Pathology labs, Scan centers, Hospitals, and Sample Collection centers. These establishments are listed and accessible through the Mytesto.in Platform.

Eligibility to Use

By accepting these Terms, you confirm and guarantee that you are at least eighteen (18) years old or older and possess the full capacity and competence to comprehend and agree to the terms, conditions, obligations, affirmations, representations, and warranties stated in these Terms.

Legal Compliance. When accessing and utilizing the Services, you confirm that you comply with all laws and regulations applicable in your country of residence. Customer reliance on this information is at their own risk, and Mytesto.in assumes no liability for losses or damages related to its use.

Mytesto.in reserves the right to charge subscription or membership fees or other charges on a per-order basis for its products or services on the platform in the future
Mytesto.in may introduce referral and incentive-based programs for customers, subject to their respective terms and conditions. By participating, customers agree to the program terms and the Mytesto.in platform terms. Mytesto.in may terminate/suspend customer accounts, credits/points, or program participation if there is a violation of the program or platform terms or engagement in fraudulent/unlawful activities. Mytesto.in also reserves the right to modify, cancel, or discontinue the program without notice.
Mytesto.in may offer credits, promo codes, vouchers, or cashback to customers, which can be modified, converted, cancelled, or discontinued at its discretion

Use of services by you or Customer

Customer account on Mytesto.in includes access to features such as 'Claim Your Business Listing'.

To access certain features of the Services, such as claiming your business listing, you must create an account. Any personal information you provide during the account creation process is subject to our Privacy Policy. It is your responsibility to maintain the confidentiality and security of your account, including your password. You are also responsible for any changes or updates made through your account and for all activities that occur in connection with your account.
You may have the option to register for the Services using your credentials from certain third-party social networking sites, such as Facebook. By doing so, you confirm that you are the owner of the social media account and authorized to disclose your login information to us. You give us permission to collect your authentication information and other relevant data from your social media account based on your settings and instructions.
When creating an account or claiming a business listing, you warrant that all information provided to us is true, accurate, and up-to-date. You agree to update your information as necessary to ensure its accuracy. If you are claiming a business listing, you represent that you are either the owner or an authorized agent of the business. You must not impersonate others, create accounts for anyone other than yourself, use someone else's email address, create multiple accounts or business listings without authorization, or provide false information to gain access to a business listing that you are not entitled to claim. You acknowledge that falsely claiming a business listing may result in substantial economic damages and losses to Mytesto.in or third parties, for which you may be held liable.
You are responsible for all activities that occur in your account, and you must promptly notify us of any unauthorized use of your account to ensure appropriate action can be taken. You agree not to allow any third party to use your Mytesto.in account and acknowledge that you will be held liable for any unauthorized access.
By creating an account, you consent to receiving certain communications related to the Mytesto.in Platform or Services. This may include comments from other Customers or notifications of activity on your account. You have the option to manage your preferences or opt-out of non-essential communications through your account settings.

Others Terms

In order to facilitate connections between you and Diagnostic centers, we offer telephony services through our phone lines, which are displayed on the specific Diagnostic center listing page on the Mytesto.in Platform. These phone lines directly connect to the Diagnostic centers' phone lines. We record information related to these calls, including voice recordings of conversations between you and the Diagnostic center, for internal billing tracking purposes and customer service improvement at the Diagnostic center's end. If you do not wish for your information to be recorded in this manner, please refrain from using the telephone services provided by Mytesto.in. By using the telephony services through Mytesto.in's provided phone lines on the Mytesto.in Platform, you explicitly agree and permit Mytesto.in to record this information.
You agree to use the Services only for purposes that are permitted by the Terms and any applicable laws, regulations, or generally accepted practices or guidelines in your jurisdiction.
You agree to pay the commission on the total revenue generated through the MYTESTO.IN platform to M/S MYTESTO Health Private Limited by accepting commission term digitally at the time of your diagnostic center registration (Mutually agreed percentage on revenue generated via mytest.in platform). M/S MYTESTO Health Private Limited will raise commission invoices on a weekly/fortnightly basis, and you agree to make payment within three working days from the date of invoice receipt. Mytesto.in reserves the right to charge a commission, subscription, and/or membership fee for any service or any other charge or fee on a per-order level from Customers on the Mytesto.in Platform at any time in the future.
You agree to use the data owned by Mytesto.in, whether available on the Services or through any other means such as API, only for personal use/purposes and not for any commercial use, unless otherwise agreed upon in writing by Mytesto.in, except in accordance with the 'Claim Your Business Listing' access.
You agree not to access or attempt to access the Services by any means other than the interface provided by Mytesto.in, unless you have been explicitly authorized to do so through a separate agreement with Mytesto.in. You specifically agree not to access or attempt to access the Services through any automated means, including the use of scripts or web crawlers, and you will comply with the instructions outlined in any robots.txt file present on the Services.
You agree not to engage in any activity that interferes with or disrupts the Services or the servers and networks connected to the Services. You shall not delete or revise any material or information posted by other Customers, and you shall not engage in spamming, including but not limited to unsolicited emailing, posting, or messaging.

Content

Mytesto.in retains ownership of its content and maintains proprietary rights over it

Mytesto.in asserts its sole and exclusive copyright ownership over the Services and its Content. We also exclusively own the IP Rights associated with the Services and Mytesto.in Content, including copyrights, trademarks, service marks, logos, trade names, trade dress, and other intellectual and proprietary rights worldwide. These rights are protected by copyright, patent, trademark, and other applicable intellectual property and proprietary rights and laws. You acknowledge that the Services contain original works that have been developed, compiled, prepared, revised, selected, and arranged by us and others through significant time, effort, and investment, and constitute valuable intellectual property. Any violation of these restrictions may result in appropriate legal proceedings against you in an appropriate forum, seeking all available remedies under the applicable laws of the country where the violation occurred. You are prohibited from modifying, reproducing, publicly displaying, or exploiting in any form or manner whatsoever any of Mytesto.in's Content, either in whole or in part, unless expressly authorized by Mytesto.in.
To the maximum extent permitted by applicable law, we neither warrant nor represent that your use of materials displayed on the Services will not infringe upon the rights of third parties not owned by or affiliated with us. According to the terms you provided, by availing the Services on the Mytesto.in Platform and submitting Your Content, you grant Mytesto.in an irrevocable, perpetual, worldwide, non-exclusive, fully paid and royalty-free, assignable, sub-licensable, and transferable license and right to use Your Content and all intellectual property rights associated with it. This license allows Mytesto.in to use Your Content for any purpose, including API partnerships with third parties, in any existing or future media. The term "use" encompasses a wide range of actions such as copying, displaying, distributing, modifying, translating, reformatting, incorporating into advertisements and other works, analyzing, promoting, commercializing, creating derivative works, and allowing users of third-party services to do the same.

Additionally, you grant Mytesto.in the right to use the name or username you submit in connection with Your Content. You also irrevocably waive any claims and assertions of moral rights or attribution that you may have with respect to Your Content against Mytesto.in, its customers, any third-party services, and their users.

Please note that these terms provide Mytesto.in with extensive rights to use Your Content and its associated intellectual property rights for various purposes, including sharing it with third parties through API partnerships.

Representations Regarding Your or Customer Content

You are responsible for Your Content. You represent and warrant that you are the sole author of, own, or otherwise control all of the rights of Your Content or have been granted explicit permission from the rights holder to submit Your Content; Your Content was not copied from or based in whole or in part on any other content, work, or website; Your Content was not submitted via the use of any automated process such as a script bot; use of Your Content by us, third party services, and our and any third party users will not violate or infringe any rights of yours or any third party; Your Content is truthful and accurate; and Your Content does not violate the Guidelines and Policies or any applicable laws
If Your Content is a review, you represent and warrant that you are the sole author of that review; the review reflects an actual test experience that you had; you were not paid or otherwise remunerated in connection with your authoring or posting of the review; and you had no financial, competitive, or other personal incentive to author or post a review that was not a fair expression of your honest opinion.
You assume all risks associated with Your Content, including anyone's reliance on its quality, accuracy, or reliability, or any disclosure by you of information in Your Content that makes you personally identifiable. While we reserve the right to remove Content, we do not control actions or Content posted by our Customers and do not guarantee the accuracy, integrity or quality of any Content. You acknowledge and agree that Content posted by Customers and any and all liability arising from such Content is the sole responsibility of the Customer who posted the content, and not Mytesto.in.

Content Removal

According to the terms provided, Mytesto.in reserves the right to take certain actions regarding Content, including Your Content, without prior notice. These actions may include removing, blocking, or disabling access to any Content that Mytesto.in considers objectionable, in violation of the Terms, or harmful to the Services or its customers, at its sole discretion. Mytesto.in is not obligated to return any of Your Content to you under any circumstances, except as required by applicable law.

Additionally, the Diagnostic centre reserves the right to delete any images and pictures that are part of Customer Content from its listing page, at its sole discretion.

In summary, Mytesto.in has the authority to take action against objectionable or harmful Content, and the Diagnostic centre can delete images and pictures from its listing page at its discretion.

Links to Third Party Websites or Resources

The Services may provide or link to content belonging to third parties, such as third-party test services or test booking. Your use of such third-party services will be governed by their respective terms of service and privacy policy. Mytesto.in may obtain business addresses, phone numbers, and contact information from third-party vendors who obtain their data from public sources.
Mytesto.in has no control over and does not endorse the accuracy, relevancy, copyright compliance, legality, completeness, timeliness, or quality of any products, services, advertisements, or other content appearing in or linked to from the Services. Mytesto.in does not screen or investigate third-party material before or after including it on the Services.

Mytesto.in expressly disclaims liability for any offensive, defamatory, illegal, invasive, unfair, or infringing content provided by third parties.

It is prohibited to post any information that is unlawful, threatening, defamatory, or obscene. If you violate this provision by using abusive language or posting objectionable information, Mytesto.in reserves the right to suspend the chat support service, block your access and usage of the Mytesto.in Platform, with or without notice.

Any content uploaded by you on the Mytesto.in Platform is subject to the relevant laws of India. If you are found to be in non-compliance with the laws, regulations, these terms, or the privacy policy of the Mytesto.in Platform, Mytesto.in has the right to immediately block your access and usage of the platform. Mytesto.in also has the right to remove any non-compliant content or comments uploaded by you and may take appropriate legal actions available under the relevant statutes.

Customer Feedback

If you share or send any ideas, suggestions, changes, or documents regarding Mytesto.in's existing business (referred to as "Feedback"), you agree to the following:

Your Feedback does not contain confidential, secretive, or proprietary information of third parties.
Mytesto.in has no obligation of confidentiality regarding such Feedback and is free to use it without any restrictions.
Mytesto.in may have already received similar Feedback from another customer or may already be considering or developing similar ideas.

Mytesto.in offers test scheduling and sample collection services by partnering with Diagnostic centre Partners. These partnerships allow the listing of their tests or services on the Mytesto.in Platform for customers to schedule tests and have samples collected.
Customers can access the tests or services listed on the Mytesto.in Platform and place orders with the Diagnostic centre Partners through Mytesto.in.
When you request to order a test or service from a Diagnostic centre Partner through the Mytesto.in Platform, it serves as an unconditional and irrevocable authorization for Mytesto.in to place the order on your behalf with the Diagnostic centre Partner(s).
Sample collection or testing for an order placed through the Mytesto.in Platform may be conducted by the Diagnostic centre Partner directly or facilitated by Mytesto.in through a third-party Sample collection or test Partner. In both cases, Mytesto.in acts as an intermediary connecting you with the Sample collection or test Partner or the Diagnostic centre Partner, depending on the situation.
If a Sample collection or test Partner accepts to conduct the sample collection or testing for your order, it establishes a contract of service between you and the Sample collection or test Partner under the applicable consumer protection laws. Mytesto.in is not a party to this contract and does not provide sample collection, testing, or logistics services. It solely enables the sample collection or testing of orders by connecting customers with Sample collection or test Partners or Diagnostic centre Partners.
When Mytesto.in facilitates the sample collection or testing for your order, it will not be held liable for any actions or omissions of the Sample collection or test Partner, including deficiencies in service, incorrect sample collection or testing, delays, tampering of test reports, and similar issues.
The Sample collection or test Partner or the Diagnostic centre Partner may charge you a sample collection or testing fee, referred to as Sample collection or test Charges. Mytesto.in is authorized to collect these charges on behalf of the Diagnostic centre Partner or Sample collection or test Partner. The Sample collection or test Charges may vary based on factors such as the Diagnostic centre Partner, order value, distance, and time of day. Mytesto.in will inform you of the applicable Sample collection or test Charges, and you will be responsible for these charges, regardless of your awareness of them.
Along with the Sample collection or test Charges, you may also be charged a Sample collection or test Surge fee for the sample collection or testing of your order. This fee is determined based on factors like distance covered, time taken, demand for sample collection or testing, real-time traffic and weather conditions, and seasonal peaks. Mytesto.in is authorized to collect the Sample collection or test Surge fee on behalf of the Diagnostic centre Partner or Sample collection or test Partner. The amount of Sample collection or test Surge fee may vary for each order, and you will be responsible for it, regardless of your awareness of the fee.
Regarding your order, Mytesto.in will issue documents such as order summaries and tax invoices in compliance with applicable legal regulations and common business practices.
It is expected that you respect the dignity and diversity of Sample collection or test Partners. You agree not to discriminate against any Sample collection or test Partner based on Discrimination Characteristics, which include race, community, religion, disability, gender, sexual orientation, gender identity, age (as permitted by relevant laws for gig work), genetic information, or any other legally protected status. You are also expected to foster a secure and harassment-free work environment for Sample collection or test Partners.

Test scheduling and Sample collection or test with Diagnostic centre Partners

The prices displayed on the Mytesto.in Platform are provided by the Diagnostic centre Partner when they are published on the platform. We make efforts to keep them updated, but the final price charged by the Diagnostic centre Partner during sample collection or testing may vary. If there is a discrepancy between the price on the Mytesto.in Platform and the price charged by the Diagnostic centre Partner, the price charged by the Diagnostic centre Partner will be considered the correct price, except for Mytesto.in's Sample collection or test Charge.

General Terms and Conditions

Mytesto.in is not involved in the health test/ sample collection/ scanning/ test. We act as an intermediary by placing orders on behalf of customers with Diagnostic centre Partners. This is done under the authority granted by customers, facilitating the booking and order process between customers and Diagnostic centre Partners.
Mytesto.in shall not be held responsible for any actions or shortcomings of the Diagnostic centre Partner, including service deficiencies, incorrect sample collection or testing, quality issues, pricing discrepancies, quantity discrepancies, or delays in preparation or testing.
The Diagnostic centre Partner(s) are solely responsible for any warranties or guarantees associated with the tests / test reports and services they provide. Mytesto.in does not assume any responsibility in this regard.
For customers in India, it is clarified that any violation of applicable rules and regulations shall be the sole responsibility of the Diagnostic centre Partner(s) /brand owners, Diagnostic centre Partner(s), or test servicesprovider,.
Please note that certain tests and services may have age restrictions. It is your responsibility to check the suitability and details of the test before placing an order. Mytesto.in shall not be held liable if the test or product ordered does not meet your requirements or restrictions.
When placing an order, you must provide accurate and complete details, including contact number and sample collection or test address. By providing these details, you agree to Mytesto.in's terms and privacy policies.
You or anyone instructed by you are prohibited from reselling tests or services ordered through the Mytesto.in Platform.
The total price of the ordered test, including sample collection and other charges, will be displayed on the Mytesto.in Platform at the time of order placement. Customers are required to make full payment for the tests or services ordered via the Mytesto.in Platform.
Any additional charges imposed by Mytesto.in, beyond the order value, will include applicable taxes.
The sample collection or test periods/time quoted at the time of ordering are approximate and subject to variation.
Personal promo codes can only be used by you, subject to the terms and conditions set by Mytesto.in from time to time

Disclaimer of warranties, limitation of liability, and Indemnification

You acknowledge and agree that the services provided by Mytesto.in, including mobile apps, are provided on an "as is" and "as available" basis, and your use of the services is at your own risk. The Mytesto.in parties, including its affiliates, officers, directors, employees, staff, branches, subsidiaries, and licensors, disclaim all warranties, express or implied, regarding the services and your use of them, to the fullest extent permitted by applicable law.

The Mytesto.in parties make no warranties or representations regarding the provision of the services with due skill, care, and diligence, or the accuracy or completeness of the content within the services. They assume no responsibility for any errors, mistakes, or inaccuracies in the content; personal injury or property damage resulting from your access to and use of the services; unauthorized access to or use of their servers and any personal information stored therein; interruption or cessation of transmission to or from the services; bugs, viruses, Trojan horses, or similar harmful elements transmitted through the services by third parties; loss of your data or content from the services; or any errors or omissions in any content or for any loss or damage incurred as a result of using any content posted, emailed, transmitted, or made available through the services.

Limitation of Liability

To the maximum extent allowed by applicable law, the Mytesto.in parties shall not be held liable for any damages incurred by you, including but not limited to:
Errors, mistakes, or inaccuracies of content.
Personal injury or property damage resulting from your access to and use of the services, including mobile apps.
Unauthorized access to or use of Mytesto.in servers and personal information stored therein.
Interruption or cessation of transmission to or from Mytesto.in servers.
Bugs, viruses, trojan horses, or similar harmful elements transmitted through the services by third parties.
Loss of your data or content from the services.
Errors or omissions in any content or any loss or damage resulting from the use of posted, transmitted, or made available content via the services.

Your failure to keep your password or account details secure and confidential.

For all Customers: Any legal action against us must be initiated within one (1) year from the time the alleged harm first occurs. During this one-year period, our failure to enforce or exercise any provision of these Terms or any related rights shall not constitute a waiver of that right or provision.

Carrier Rates May Apply: When accessing the Services through a mobile or other device, you may be subject to charges from your Internet or mobile service provider. Please check with them beforehand, as you will be solely responsible for any costs incurred.
